Learn with Hupe is a children's educational app operated by Hupe and Co Pty Ltd (ABN: 30 682 191 653) ("Learn with Hupe", "we", "us", "our"). For queries, contact us at hello@learnwithhupe.com.au.

By creating an account, starting a free trial, or subscribing to the App, you confirm that:

• You are aged 18 or over
• You are the parent or legal guardian of any child who will use the App
• You have read, understood and agree to these Terms
• You have read our Privacy Policy at learnwithhupe.com.au/privacy

If you do not agree to these Terms, you must not create an account or use the App.

Learn with Hupe provides an interactive, curriculum-aligned educational app for children aged 2–8. The App includes:

• Animated, interactive learning topics across Mathematics, English, Science, Logic, and Geography
• Content aligned to the Australian NSW K–10 curriculum and the Early Years Learning Framework
• Child profile management for up to 8 child profiles per subscription
• A built-in 30-minute screen time session limit
• Progress tracking and reporting for Account Holders
• Offline access to downloaded content

We reserve the right to update, modify, or discontinue features of the App at any time. We will provide reasonable notice of material changes.

We offer a 14-day free trial for new Account Holders. During the trial:

• Full access to all App features and content is provided
• Payment details are required to start the trial, and no charge is made during the trial period
• At the end of the 14-day trial period, your chosen plan begins unless you cancel before the trial ends

One free trial is available per household. We reserve the right to decline or terminate a free trial if we reasonably believe it is being misused.

5.1 Plans. We offer two subscription plans:

• Monthly Plan: AUD $7.99 per month, billed monthly, up to 8 child profiles
• Annual Plan: AUD $69.99 per year, billed annually, up to 8 child profiles

Prices are inclusive of any applicable GST. Prices are subject to change with 30 days' notice to Account Holders.

5.2 Billing. Subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. Billing is managed by Apple or Google under their respective terms and policies. We do not directly process or store payment card information.

5.3 Automatic renewal. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. To avoid being charged for the next period, you must cancel at least 24 hours before the renewal date through your App Store or Google Play account settings.

5.4 Price changes. We will provide at least 30 days' notice of any price change. If you do not cancel before the new price takes effect, you will be deemed to have accepted the new price.

6.1 Cancellation. You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the App until that date.

6.2 Refunds. Refunds for in-app subscriptions are governed by Apple's or Google's refund policies, as applicable. We recommend contacting Apple Support or Google Play Support directly for refund requests. We will cooperate with any legitimate refund process. As a goodwill gesture, if you experience a significant technical issue that prevents your child from using the App and we are unable to resolve it within 7 days, contact us at hello@learnwithhupe.com.au to discuss a pro-rata refund or account credit.

As an Account Holder, you are responsible for:

• Maintaining the security of your login credentials and not sharing them with others
• Ensuring all information provided to us is accurate and up to date
• Supervising your child's use of the App in a manner appropriate to their age
• Any activity that occurs under your account
• Ensuring your device meets the minimum technical requirements for the App

You must not share your account with households outside your own family unit. Each household requires its own subscription.

You agree not to:

• Use the App for any unlawful purpose
• Attempt to access, extract, copy or reproduce our content, animations, audio, or curriculum materials without written permission
• Reverse engineer, decompile, or modify the App or any part of it
• Use automated tools to access or scrape the App
• Create multiple accounts to circumvent subscription requirements or the free trial limit
• Resell or sublicense access to the App

All content within the App — including but not limited to animations, characters, voiceovers, interactive activities, curriculum content, scripts, and visual design — is owned by or licensed to Hupe and Co Pty Ltd and is protected by Australian and international copyright, trade mark, and intellectual property laws.

Your subscription gives you a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial educational purposes within your household. No other rights are granted.

"Learn with Hupe" is a trade mark of Hupe and Co Pty Ltd. You may not use our trade marks without prior written consent.

The App is designed with the following child safety commitments, which form part of our service offering:

• No advertising or sponsored content of any kind
• No in-app purchases beyond the subscription
• No social features, chat, or interaction with other users
• No streak mechanics, randomised rewards, or time-pressure game design
• A built-in 30-minute session limit with calm, non-punitive messaging
• No negative reinforcement or failure screens

These commitments are intentional design decisions. We reserve the right to update them in ways that enhance child wellbeing, but will not remove them in ways that compromise the safety of our youngest users.

The App is provided "as is" and "as available". To the fullest extent permitted by Australian law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components. We do not guarantee any specific learning outcomes from use of the App.

To the fullest extent permitted by law, our total liability for any claim arising out of or in connection with these Terms or your use of the App is limited to the amount you paid for your subscription in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of learning outcomes. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Australian Consumer Law.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

We may update these Terms from time to time. We will notify Account Holders of material changes by email at least 14 days before they take effect. Continued use of the App after notification constitutes acceptance of the updated Terms. If you do not accept the new Terms, you may cancel your subscription before they take effect.
